GENERAL TERMS OF SALE

Object and Conclusion of the Contract
1.1. These general terms of sale apply to the purchase of Arianna Couture branded products (hereinafter “Products”) made through the e-commerce website www.ariannacouture.com (hereinafter the “Site”) by users qualifying as “Consumers” as defined in article 1.4 below. The Site is owned by Arianna Couture S.p.A. (hereinafter “Owner,” “Arianna Couture,” or “Seller”).

1.2. Any communication by the Consumer concerning and/or relating to the Product purchased—including reports, complaints, or exercising the right of withdrawal—should be sent to the Seller via the contact details provided on the Site or by email at [email protected].

1.3. All purchases are governed by the general terms of sale published on the Site at the time the Consumer places the order.

1.4. The Site deals with retail sales and is intended exclusively for consumer Customers (hereinafter “Customer” or “Consumer”). Non-Consumers are invited not to place orders. If sales are made to non-Consumers, these general terms shall apply with the following exceptions:

  • The right of withdrawal (article 10) does not apply.
  • The Product warranty (article 8) does not apply.
  • Consumer-specific provisions reflecting legal requirements will not apply.
  • The sales contract will be governed by Italian law, excluding the United Nations Convention on Contracts for the International Sale of Goods.

1.5. The contract between Arianna Couture and the Customer is finalized upon acceptance of the order by the Seller. If the order is not accepted, the Seller will inform the Customer promptly.

1.6. When placing an order, the Customer must review all information provided during the purchasing process and accept these terms in full.

1.7. These Terms may be printed or saved for reference as permitted by applicable law.

1.8. The Consumer agrees to receive order confirmations and these terms of sale via email.

1.9. Consumers must be of legal age (18 years or older) and have legal capacity.

1.10. The Customer is responsible for any internet connection costs incurred when accessing the Site.

Products Features and Availability
2.1. Products are described on the Site according to the terms published at the time of purchase. Product images are for informational purposes and may differ slightly due to display settings.

2.3. Arianna Couture reserves the right to modify these terms or product details at any time without prior notice. Changes will apply only to sales concluded after publication.

2.4. Products can be delivered only to the countries listed on the Site.

Purchasing Methods and Completion of the Contract
3.1. The display of Products on the Site serves as an invitation to offer, not a binding offer.

3.2. A Consumer’s order is considered a contractual proposal governed by these terms.

3.3. The Seller accepts the Consumer’s order via an order confirmation email, which includes the terms of sale and order details.

3.4. The purchase contract is finalized when the Consumer receives the order confirmation email.

Products Selection and Purchasing Procedure
4.1. The Consumer can purchase Products displayed on the Site by selecting items of interest and placing them in the virtual shopping cart. Once the selection is complete, the Consumer must either:

  • (i) Register with the Site by providing personal details;
  • (ii) Log in if already registered; or
  • (iii) Provide necessary personal details to complete the order without registration.

The Consumer must confirm or update their information, including the delivery address, billing address, and optional contact details.

4.2. The order summary, including the Products selected, total price, and delivery costs, will be displayed before confirming the purchase. At this stage, the Consumer must review the order, agree to these terms by selecting the relevant checkbox, and confirm the purchase by clicking the “Place Order” button.

4.3. After the order is submitted, the Seller will send a confirmation email containing the order details, the link to these terms, and other relevant information.

Delivery and Acceptance of Goods
5.1. The Site specifies Product availability and estimated delivery times; these are indicative and not binding.

5.2. The Seller strives to deliver within the specified time frame but guarantees delivery within 30 days from the order placement date. If a Product is unavailable, the Seller will inform the Consumer and issue a refund.

5.3. If only part of an order is available, the Consumer will be notified and asked to confirm delivery of the available items.

5.4. The Consumer must inspect the delivery for completeness and report any issues promptly to the Seller.

Prices, Shipping Costs, Customs Duties, and Taxes
6.1. Product prices are those listed on the Site at the time of purchase and include VAT (if applicable) but exclude shipping costs.

6.3. For deliveries outside the EU, customs duties and taxes are the responsibility of the Consumer.

Payments
7.1. Payments must be made via the methods available on the Site, including bank transfer, credit card, or PayPal.

7.5. The Seller does not store payment information and disclaims responsibility for misuse of payment data by third parties.

Seller’s Warranty of Conformity
8.1. The Seller guarantees Products are free of defects for two years from delivery, provided they are used as directed.

8.3. Defects must be reported within two months of discovery via the appropriate form or email.

Right of Withdrawal
10.1. Consumers may withdraw from a contract within 14 days of receiving the Product.

10.5. Refunds will be issued within 14 days of withdrawal, using the original payment method unless otherwise requested.

Intellectual Property Rights
11.1. All brands, designs, and content on the Site are the exclusive property of Arianna Couture.

Consumer Data and Privacy
12.1. Personal data collected during purchases is processed according to the Privacy Policy available on the Site.

Applicable Law and Dispute Resolution
13.1. These terms are governed by Italian law.

13.2. Consumers may access the European Commission’s dispute resolution platform at http://ec.europa.eu/odr.

13.3. Unresolved disputes will be referred to the competent court in the Consumer’s place of residence.
