GENERAL TERMS OF SALE

1. Object and Conclusion of the Contract

1.1. These General Terms of Sale apply to purchases of products offered under the Casa di Bohemé brand (hereinafter “Products”) made through the website www.casadiboheme.com (hereinafter the “Site”) by users who qualify as consumers, as defined in section 1.4 below. The Site is owned and operated by Botezatu Residence SRL, CUI: 51059053 (hereinafter the “Owner,” “Casa di Bohemé,” or the “Seller”).

1.2. Any communication regarding purchases, including order updates, complaints, or withdrawal requests, should be sent to the Seller via the contact form on the Site or by email at casadiboheme.shop@gmail.com.

1.3. All purchases are subject to the General Terms of Sale published on the Site at the time the order is placed.

1.4. This Site is intended exclusively for sales to final customers acting as Consumers. If a purchase is made by a non-Consumer (e.g., a business or professional), the following consumer protections will not apply:

  • Right of withdrawal (section 10)

  • Legal product warranty (section 8)

  • Consumer-specific protections as required by Romanian or EU law
    The contract will still be governed by Romanian law, excluding the United Nations Convention on Contracts for the International Sale of Goods.

1.5. The purchase contract is concluded upon acceptance of the order by the Seller. If the order is not accepted, the Customer will be informed promptly.

1.6. By placing an order, the Customer confirms having reviewed and accepted these terms in full.

1.7. These terms can be printed or saved for future reference in accordance with applicable law.

1.8. The Consumer agrees to receive order confirmations and legal documentation via email.

1.9. Customers must be at least 18 years old and legally capable of entering into a binding agreement.

1.10. Internet connection fees, if any, are the Customer’s responsibility.

2. Product Features and Availability

2.1. Products are described on the Site based on the information available at the time of publication. Images are for reference only and may vary slightly due to screen display settings.

2.2. Casa di Bohemé reserves the right to update product details or these terms at any time. Such changes apply only to purchases made after the date of publication.

2.3. Deliveries are available only in the countries listed on the Site at the time of purchase.

3. Order and Contract Finalization

3.1. Product listings on the Site do not represent a binding offer but an invitation to purchase.

3.2. When placing an order, the Customer submits a purchase proposal governed by these terms.

3.3. Acceptance is confirmed via email, which will include order details and a link to these terms.

3.4. The contract is finalized when the Customer receives the confirmation email.

4. Purchasing Process

4.1. To purchase, the Customer selects products, adds them to the shopping cart, and proceeds through checkout. The Customer may:

  • Register and log in to their account

  • Proceed as a guest by entering the necessary contact and delivery details

4.2. A summary of the order will be shown before payment. Customers must review this summary and confirm agreement with the Terms of Sale before clicking “Place Order.”

4.3. An order confirmation email will follow, including order details and a copy of these terms.

5. Delivery and Acceptance

5.1. Product availability and delivery estimates are shown on the Site for reference only.

5.2. Deliveries are typically made within 30 days of order confirmation. If a Product becomes unavailable, the Customer will be informed and refunded.

5.3. In case of partial availability, the Customer will be contacted to choose whether to receive the available items or cancel the full order.

5.4. The Customer is responsible for checking that the delivery is complete and must report any issues promptly.

6. Prices, Shipping, Duties, and Taxes

6.1. Prices are listed on the Site and include VAT, where applicable. Shipping costs are shown separately.

6.2. For deliveries outside the EU, customs duties, import taxes, and related charges are the Customer’s responsibility.

7. Payment

7.1. Payments can be made using the methods available on the Site, such as credit/debit card, PayPal, or bank transfer.

7.2. Payment data is not stored by Casa di Bohemé. The Seller is not liable for misuse of payment data by third parties.

8. Product Warranty

8.1. Casa di Bohemé guarantees that all Products are free from defects for a period of two years from the date of delivery, in accordance with Romanian consumer law.

8.2. Defects must be reported within two months of discovery, via email or the dedicated form on the Site.

10. Right of Withdrawal

10.1. Consumers have the right to withdraw from a purchase within 14 days of receiving the product, without giving any reason.

10.2. To initiate a return, the Customer must fill out the return form provided on the Site.

10.5. Refunds are issued within 14 days of withdrawal confirmation, using the same payment method unless otherwise agreed.

11. Intellectual Property

11.1. All trademarks, logos, content, and designs on the Site are the exclusive property of Botezatu Residence SRL or its licensors. Use, reproduction, or distribution without permission is strictly prohibited.

12. Personal Data and Privacy

12.1. Customer data is processed in accordance with the Site’s Privacy Policy, available at www.casadiboheme.com/privacy-policy.

13. Governing Law and Dispute Resolution

13.1. These terms are governed by Romanian law.

13.2. In case of disputes, Consumers may use the European Commission’s online dispute resolution platform at http://ec.europa.eu/odr.

13.3. If a dispute cannot be resolved amicably, jurisdiction lies with the competent Romanian courts of the Consumer’s residence.
